Last February 10, 2010, the Court struck down on constitutional grounds the creation of the Province of Dinagat Island. In its decision the Court said that the Constitution clearly mandates that the creation of local government units must follow the criteria established in the Local Government Code. The Court added that creation of the Province of Dinagat failed to comply with these requirements specifically on the land area requirement and population.
